These Terms of Service ("Terms") are an agreement between you and Linnas Labs LLC ("DealsPlug", "we", "us"), the company that operates the DealsPlug app and website (the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use DealsPlug. Our Privacy Policy explains how we handle your information.
Who can use DealsPlug
- You must be at least 13 years old to use DealsPlug.
- To create a business account, you must be at least 18 and have the authority to act for the business you register.
- You may not use DealsPlug if you are barred from doing so under the laws that apply to you.
Deals on DealsPlug
DealsPlug helps you discover deals offered by restaurants and other businesses. Deals come from businesses that submit them to us and from publicly available promotions.
- Deals are offered by the businesses, not by us. Each business decides its own offer, terms, availability and whether to honor it. Please confirm the details with the business before you rely on a deal.
- We don't guarantee deals. Deals can change, sell out or end without notice, and we can't promise that every listing is accurate or current.
- Brands aren't affiliated with us. Trademarks, brand names and logos shown in DealsPlug belong to their owners. Showing them doesn't mean the brand endorses or partners with DealsPlug.
- Leaving the app. Some features open other apps and websites, such as a restaurant's app, a maps app, or Stripe's checkout page. Those services have their own terms and policies, and we aren't responsible for them.
Business accounts
If you create a business account:
- Give us accurate, current information and keep it up to date.
- Keep your password private. You are responsible for activity on your account.
- You can delete your account at any time in the app: open the Business Dashboard, tap the menu (three dots), then Delete account.
Deals you submit
- Your responsibility. You're responsible for the deals and content you submit, including text, images, logos and locations. You confirm that you have the right to share that content, that your deal is accurate and lawful, and that your business will honor it as described.
- Permission to display it. You give us a non-exclusive, worldwide, royalty-free license to host, display, format and promote the content you submit, in DealsPlug and in marketing for DealsPlug, for as long as it's listed and for a reasonable time after.
- Review. Every submission is reviewed. We may approve, reject, edit for clarity and formatting, or remove a deal at our discretion, and approval isn't guaranteed.
- What we don't list. DealsPlug is for all ages, so we don't list deals whose offer is alcohol, tobacco, vaping or cannabis products, or anything else for adults only. Restaurants and bars that serve alcohol are welcome, as long as the deal itself isn't for those products.
- Deal limits. To keep the feed fair, each business can have a limited number of deals at once: currently 3 live, 3 coming soon and 2 ongoing. We may change these limits.
Paid services
Businesses can buy the following. Prices are shown in the app before you pay.
- Deal submission fee: a one-time fee per deal submitted for review. It isn't refunded if the deal isn't approved, but you can fix a deal we didn't approve and resubmit it once at no extra charge (in the app under My Submissions).
- Pro Partner: a monthly subscription that renews automatically each month and is charged to your payment method until you cancel. Pro Partners can submit deals without the submission fee, get an analytics dashboard, a Pro badge and priority review, and their live deals take turns in the Featured spot at the top of the feed for people within about 10 miles of their locations. Where Featured placements were bought for the same area, Pro Partner deals get about one turn in four and the purchased placements the rest. Like Featured placements, they're labeled Sponsored. You can cancel at any time in the app: open the Business Dashboard and tap Manage subscription (you can also contact us). Canceling stops future charges, and you keep Pro Partner until the end of the period you've paid for. Deleting your account cancels the subscription immediately.
- Featured placements: a one-time purchase that shows one of your live deals in the Featured spot at the top of the feed, for people within about 10 miles of the location you choose, for the number of days you buy. When several businesses buy placements covering the same area, they share the spot and take turns so each gets a fair share of time. Pro Partner deals in the area also get about one turn in four. Placements are labeled Sponsored. A placement isn't guaranteed to be on screen at every moment. It ends early if the deal ends or is removed.
Payments are processed by Stripe, and by paying you also agree to Stripe's terms. Prices don't include sales tax, which is added at checkout where it applies. You're responsible for any applicable taxes. Except where the law requires otherwise, payments are non-refundable. We may change prices for future purchases, and we'll tell Pro Partners about a price change before it applies to their subscription.
Acceptable use
When using DealsPlug, you agree not to:
- Submit false, misleading or fraudulent deals, or deals you don't intend to honor.
- Post content that infringes someone else's rights, or that is unlawful, hateful or harmful.
- Copy, scrape or harvest content or data from DealsPlug with automated tools.
- Interfere with the Service, try to get around its security or payment systems, or access other people's accounts.
- Reverse engineer the app, except where the law allows it.
We may suspend or close accounts that break these rules, and remove content that does.
Our content
The DealsPlug name, logo, app and design belong to Linnas Labs LLC. We give you a personal, non-transferable permission to use the app for its intended purpose. You may not copy or resell the Service.
Disclaimers
DealsPlug is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties, express or implied, including about the accuracy or availability of any deal, and we don't promise that the Service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent the law allows, Linnas Labs LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of DealsPlug or any deal listed in it. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Some places don't allow these limits, so they may not apply to you.
Indemnity
If you're a business, you agree to defend and compensate Linnas Labs LLC for claims, losses and costs (including reasonable legal fees) that result from the deals and content you submit, or from your breaking these Terms.
Ending your use
You can stop using DealsPlug at any time and delete your business account in the app. We may suspend or end access to the Service if you break these Terms or if we need to for legal or security reasons. Sections that by their nature should continue (such as the license you gave us for past listings, payment obligations, disclaimers and limits of liability) survive after your use ends.
Apple App Store
If you downloaded DealsPlug from Apple's App Store:
- These Terms are between you and Linnas Labs LLC, not Apple. Linnas Labs LLC, not Apple, is responsible for the app and its content.
- Your right to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's usage rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet a warranty that applies to it, you can notify Apple, and Apple will refund the app's purchase price (if any). Apple has no other warranty obligation for the app.
- Linnas Labs LLC, not Apple, is responsible for handling any claims about the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property infringement claims.
- You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll update this page and the "Last updated" date, and if a change is significant we'll let business account holders know by email or in the app. If you keep using DealsPlug after a change, you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located there, unless the law where you live requires otherwise.
